Preamble
These Terms of Service apply to all individuals and entities accessing or using the Perch platform anywhere in India. By using Perch, you agree to comply with and be bound by these Terms in their entirety. If any term conflicts with applicable law, the law shall prevail and the remaining terms shall continue in force.
Acceptance of Terms
These Terms of Service (the “Terms”) constitute a binding legal agreement between you and Perch Technologies Private Limited (“Perch”, “we”, “us”, or “our”).
1.1Binding agreement
By accessing the Perch website (perch.in), the Perch mobile application, or any related services (collectively, the “Platform”), or by registering an account, listing a property, or completing a booking, you acknowledge that you have read, understood, and agreed to be bound by these Terms, our Privacy Policy, and any applicable supplemental terms.
If you are using the Platform on behalf of a company, partnership, or other legal entity, you represent that you have authority to bind such entity to these Terms.
1.2Capacity to contract
You confirm that you are at least 18 years old, are competent to enter into a contract under the Indian Contract Act, 1872, and are not legally barred from receiving services in India.
If you do not agree to any provision of these Terms, you must not access or use the Platform.
Definitions
2.1Key terms
“Tenant” means an individual booking accommodation through the Platform.
“Owner” or “Host” means an individual or legal entity listing a property for occupancy on the Platform.
“Booking” means a confirmed reservation of accommodation between a Tenant and an Owner facilitated by the Platform.
“Listing” means a property profile published on the Platform, including photographs, amenities, pricing, availability, and house rules.
“User Content” means any text, photographs, videos, reviews, ratings, or other material submitted by users to the Platform.
“Services” means the technology, support, payments, mediation, and verification services made available by Perch.
Eligibility & Account Registration
3.1Eligibility
Use of the Platform is restricted to individuals at least 18 years of age. Minors may only be hosted with documented guardian consent and matching identity verification.
We may refuse service, suspend an account, or cancel a Booking at our sole discretion, including where information provided is incomplete, inaccurate, or believed to be fraudulent.
3.2Account registration
To access most features, you must create an account by providing accurate, current, and complete information including your full legal name, contact email, phone number, and a valid government-issued identity document for KYC.
You are responsible for maintaining the confidentiality of your login credentials and for all activity occurring under your account. You must notify us immediately at security@perch.in upon any unauthorised access.
3.3Identity verification (KYC)
All Tenants must complete identity verification through Aadhaar (with masked DOB), PAN, Driving Licence, or Passport before move-in. Working professionals must additionally provide an employer letter or company ID; students must provide a current college admission letter or active student ID.
All Owners must provide proof of property ownership (sale deed, khata, or registered lease), PAN, GST registration where applicable, and a cancelled cheque for payouts. Re-verification is conducted every six (6) months or upon any material change.
Role of Perch
4.1Marketplace facilitator, not broker
Perch operates as a technology marketplace platform connecting Tenants and Owners. We are not a real estate broker, lessor, sub-lessor, agent, or guarantor for any party.
All lease agreements are executed digitally between Tenant and Owner. Perch acts as a facilitating witness via timestamp, IP-trace, and document hash.
Perch does not own, manage, or operate listed properties unless explicitly tagged “Perch Managed” on the Listing.
4.2Verification scope
While Perch performs reasonable physical and document-based audits, we do not guarantee the absolute accuracy, completeness, or condition of any property at all times. Tenants are encouraged to schedule a personal or video walkthrough before booking.
Tenant Obligations
5.1House rules and conduct
Tenants must respect the published House Rules of each property, including quiet hours, guest policies, and shared-space cleanliness. Smoking, illegal substances, and unregistered overnight guests are strictly prohibited.
Damage to property beyond reasonable wear-and-tear is chargeable at replacement cost, supported by photographic inspection evidence.
Sub-letting or allowing third-party occupancy without prior written approval from the Owner and Perch is prohibited.
5.2Lease tenure & notice period
The default lease tenure is six (6) months. Properties may offer flexible 1-month or 3-month plans, clearly tagged as “Short Stay”.
Early exit before the agreed lock-in attracts a one (1) month rent penalty unless waived by Perch in cases of documented medical, employment, or safety emergencies.
A thirty (30) day prior written notice via the in-app vacate flow is mandatory after the lock-in period. Notices are date-stamped and binding.
Owner Obligations
6.1Listing accuracy & maintenance
Owners must ensure that every Listing accurately represents the property as it exists, including photographs taken within ninety (90) days, current pricing, real availability, and complete amenity disclosures.
Owners must maintain the property in safe, hygienic, habitable condition. Routine maintenance — plumbing, electricals, internet uptime (minimum 50 Mbps), pest control, and shared-area cleaning — is the Owner's responsibility.
Maintenance requests raised through the dashboard must be acknowledged within twenty-four (24) hours and resolved within seventy-two (72) hours, except major repairs which must be resolved within seven (7) calendar days.
6.2Owner cancellations & disruption
Calendar accuracy is mandatory. Double-bookings or Owner-initiated cancellations within fourteen (14) days of move-in attract a flat ₹2,000 disruption fee per occurrence and a Perch-funded relocation cost differential up to ₹5,000.
More than three (3) Owner cancellations in a calendar quarter result in a thirty (30) day suspension and audit review.
Fees, Pricing & Payments
7.1Pricing & taxes
All prices on the Platform are inclusive of applicable Goods and Services Tax (GST) unless explicitly marked otherwise. Tax invoices are auto-generated and emailed within twenty-four (24) hours of payment confirmation.
Optional add-ons (premium meals, laundry packages, etc.) are charged separately and only when explicitly opted in by the Tenant.
7.2Rent, late fees & penalty
Monthly rent is due by the 5th of each calendar month. A three (3) day grace period applies, after which a 2% per-week late fee accrues on the outstanding amount.
Tenants exceeding thirty (30) days of non-payment may be issued a written eviction notice with a seven (7) day cure period.
Pro-rated rent applies for partial months (entry/exit) calculated on a 30-day base.
7.3Owner commission & payouts
Perch charges Owners a flat commission of five percent (5%) on successful, completed Bookings. There are no listing fees, boost fees, or hidden charges.
Payouts are processed every seven (7) calendar days (T+7 cycle) directly to the Owner's registered bank account. Statements are downloadable as PDF or CSV from the Owner dashboard.
Tax Deducted at Source (TDS) under Section 194-O of the Income Tax Act, 1961 is automatically deducted and reflected in monthly statements.
Cancellations, Refunds & Security Deposits
8.1Free cancellation window
Tenants may cancel a Booking free of charge within twenty-four (24) hours of confirmation, provided no move-in has occurred.
Cancellations made between twenty-four (24) hours and seven (7) days before the move-in date attract a flat ₹500 processing fee.
Cancellations within seven (7) days of move-in result in forfeiture of the first month's rent (booking advance), unless backed by medical or employment documentation acceptable to Perch.
No-shows on the move-in date — without forty-eight (48) hour prior notice — forfeit the booking advance plus a security deposit equivalent of one (1) week's rent.
8.2Security deposits
The standard security deposit is one (1) month's rent. Deposits are held in a Perch-managed escrow account, not by the Owner.
Refundable up to one hundred percent (100%) within fifteen (15) business days of move-out inspection. Deductions, if any, are itemised with photographic evidence and shared via the dashboard within seven (7) days of vacating.
Tenants may dispute deductions within seven (7) days of receipt; disputes are arbitrated by Perch within fourteen (14) working days and decisions are binding on the Owner.
8.3Listing accuracy guarantee
If on move-in a property materially deviates from its Listing in size, key amenities, or occupancy, the Tenant is entitled to a full refund and a free relocation to an equivalent property. Claims must be raised within forty-eight (48) hours of move-in with photographic evidence.
User Content, Reviews & Conduct
9.1Reviews & ratings
Reviews are accepted only from Tenants who have completed at least fourteen (14) nights at a property. Owners may post one (1) public response per review but cannot edit or remove it.
Perch removes reviews only on confirmation of: factual fabrication, hate speech, doxxing, or breach of confidentiality.
9.2Content licence
By submitting User Content, you grant Perch a non-exclusive, worldwide, royalty-free, sub-licensable, and transferable licence to use, reproduce, modify, adapt, publish, translate, and display such content on the Platform and in marketing materials.
You represent and warrant that you own or have the necessary rights to submit User Content and that it does not infringe any third party's rights.
9.3Prohibited conduct
Users must not: post fraudulent, misleading, or unlawful content; circumvent Perch's payment system; harass, threaten, or discriminate against other users; reverse-engineer or scrape the Platform; or use the Platform for any illegal purpose.
Violations may result in immediate suspension or termination of the account, forfeiture of pending payouts, and legal action.
Privacy & Data Protection
10.1Data handling
Personal data is processed in accordance with our Privacy Policy and applicable Indian laws including the Information Technology Act, 2000 (and rules thereunder) and the Digital Personal Data Protection Act, 2023 (DPDP Act).
Data is encrypted at rest (AES-256) and in transit (TLS 1.3) on India-based servers.
10.2Data sharing
We share personal data with Owners only after a confirmed Booking and only to the minimum extent required (name, phone, KYC reference ID — never raw documents).
We do not sell, rent, or trade personal data with third parties for marketing.
10.3Data subject rights
You may request a complete data export, correction, or deletion via privacy@perch.in. Such requests are completed within thirty (30) days, subject to legal retention obligations.
Intellectual Property
11.1Perch IP
All trademarks, logos, software, design, content, and materials made available on the Platform are owned by or licensed to Perch and are protected under applicable laws including the Indian Copyright Act, 1957 and the Trade Marks Act, 1999.
No part of the Platform may be copied, reproduced, modified, distributed, or used for commercial purposes without prior written consent from Perch.
Disclaimers & Limitation of Liability
12.1Service “as-is”
The Platform is provided on an “as-is” and “as-available” basis. Perch makes no warranty, express or implied, regarding uninterrupted availability, error-free operation, or fitness for a particular purpose, except as expressly stated in these Terms.
12.2Limitation of liability
To the maximum extent permitted by law, Perch's aggregate liability arising out of or relating to these Terms or the Services shall not exceed the total fees received by Perch from the relevant user in the six (6) months preceding the event giving rise to the claim, or ₹15,000, whichever is greater.
In no event shall Perch be liable for any indirect, incidental, consequential, special, or punitive damages including loss of profits, data, goodwill, or business interruption.
12.3Force majeure
Neither party shall be liable for failure to perform any obligation due to natural disasters, government actions, civil unrest, pandemics, internet outages, or other comparable force majeure events. Refunds and rebookings during such events are processed on a pro-rated, good-faith basis.
Indemnification
13.1User indemnity
You agree to indemnify, defend, and hold harmless Perch, its directors, officers, employees, and affiliates from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of: (a) your breach of these Terms; (b) your User Content; (c) your violation of any applicable law; or (d) your infringement of any third party right.
Suspension & Termination
14.1Voluntary termination
You may terminate your Perch account at any time via the in-app settings or by writing to support@perch.in, subject to honouring any active Bookings.
Owners may exit the Platform with thirty (30) day prior written notice.
14.2Termination for cause
Perch may suspend or terminate your account immediately, without prior notice, for: failed re-audits, repeated SLA breaches, fraudulent listings, tenant safety violations, payment failures, or breach of these Terms.
Pending payouts may be withheld to the extent required to settle confirmed refunds, deposit returns, or damages.
Disputes, Mediation & Arbitration
15.1Internal mediation
All Tenant–Owner disputes are first mediated by Perch's Trust & Safety team within forty-eight (48) hours of escalation. Both parties must respond to mediation requests within seventy-two (72) hours; non-response is treated as concession.
Compensatory adjustments up to ₹15,000 per case may be ordered as part of mediation.
15.2Binding arbitration
Unresolved disputes shall proceed to arbitration under the Arbitration and Conciliation Act, 1996, by a sole arbitrator appointed by Perch. The seat and venue of arbitration shall be Bengaluru, Karnataka. Proceedings shall be conducted in English.
Class action proceedings are expressly waived; users agree to bring claims individually.
Governing Law & Jurisdiction
16.1Applicable law
These Terms are governed by and construed in accordance with the laws of India.
Subject to Section 15 (Arbitration), the courts at Bengaluru, Karnataka shall have exclusive jurisdiction over any matter arising out of these Terms.
Modifications to Terms
17.1Notice of changes
Perch may revise these Terms from time to time. Material changes will be notified at least fifteen (15) days in advance via email and an in-app banner.
Continued use of the Platform after the effective date constitutes acceptance of the revised Terms. Users disagreeing with revisions may terminate their account without penalty within the notice window.
Miscellaneous
18.1Entire agreement & severability
These Terms, together with the Privacy Policy and any supplemental terms, constitute the entire agreement between you and Perch regarding the Platform and supersede any prior agreements.
If any provision is held invalid or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect.
18.2Assignment & waiver
You may not assign or transfer these Terms or any rights hereunder without our prior written consent. Perch may freely assign these Terms in connection with a merger, acquisition, or sale of assets.
No waiver of any provision shall be deemed a waiver of any other provision or of such provision on any other occasion.
